QUESTION

Coroner will not issue report

Asked on Jul 13th, 2019 on Wills and Probate - West Virginia
More details to this question:
My uncle committed suicide in Davis, WV but was not found for approximately 2 months. The WV Coroner will not issue a death certificate and it has been over 2 months. They cannot determine if it is my uncle and my father, who is 85, is trying to sort this out from Austin, TX. There is no next of kin nor a will, so we are now paying for insurance, car, etc. and trying to settle his small estate. Can anything be done or is this up to Coroner to decide (e.g., can we petition the court for some type of ruling so we can settle his estate). It is very small and we cannot find a will, so this is complicated.

If your uncle left no spouse or children or parents, his siblings, including your father, are his next of kin. The law governing the estates of people who have died varies from state to state.  Some states have a special procedure for small estates.  A West Virginia lawyer can advise you on what to do.  Meanwhile, no one is obliged to make car or insurance or other payments.

This is general information. It cannot substitute for a personal consultation with an attorney. It is not intended to be legal advice or imply an attorney-client relationship.
