My partner passed away 2 months ago and the family is claiming that they have a will and testament from the deceased. We have a joint ownership of the house and the deed says that I have the right to claim of survivorship. and also they are saying that they are ready to file the estate for probate and that includes the house where I'm living right now. What do I need to do?

Deeds trump wills. See a local probate lawyer about the process for transferring the home 100% to you under Virginia law.
