Do I have a case for legal action

More details to this question:
About a year after my Grandmothers passing my uncle (who to my knowledge is the executor of her will) informed us that we would be receiving around $60,000 each in two separate payments. The first payment would be from her liquidized assets and bank account savings and the 2nd payment would come after that house was sold. We received the first payment 2 years ago but since then he has ignored our every inquiry, however did say there was an “estate audit” going on for 2 year and has kept us in the shadow with every piece of information. We are convinced he stole our money

You write that you are convinced but offer no evidence.  Check with the local probate court to determine whether indeed the estate is being audited.  If not, contact a local probate lawyer.  Many states have a date following which the heirs or beneficiaries can request an accounting and a later date by which they can ask the court to replace an executor who has not made distributions.
