QUESTION

Do text messages have any validity as a contract /real estate transaction ?

Asked on Nov 04th, 2023 on Wills and Probate - Texas
More details to this question:
My son entered into a contract to buy his fathers house. Being that it was his father they did not draw up a contract. Now his father has passed and his step mother is asking him to give the house back. All he has is the text messages they exchanged. Thank you. You can reach me by email or text msg. The contract may be unenforceable because both spouses need to consent to sell property if it's homestead. This is the general rule followed in many jurisdictions so you need to reach out to counsel in Texas for more specific advice.
