Do we have to go through probate to settle an estate?

More details to this question:
My mother’s husband recently passed. They had been married for over 30 years. They lived in my mother’s home all that time. Her name is the only name on property. He has a truck that $18000 is still owed. His children want his truck, assorted power tools they say are his. They also want his hunting and fishing gear. We have no problem with most of this but we believe they must pay what is due on truck.

You must go through probate to settle an estate.  Probate is proving what was owned, what was owed and to whom the balance should go, whether under a Will or, if there was no Will, the state's laws of inheritance.  However, given the size of the estate, an informal probate may be available.  Please contact a probate attorney who practices in the county in which the person died.
