QUESTION

Does getting married invalidate a will if the new spouse isn't included? If so, must the will be probated?

More details to this question:
My uncle remarried three years after making his will. I agreed to be his executor. My uncle declined to make new will. His attorney said the will is still valid and must be probated, even though none of what is in the will will be carried out. Is that right, and if so, why?

What you want doesn't matter.  The inheritance is a gift.  Your uncle chose who he wanted to give the gift to when he made the Will.
