QUESTION

Executor of a will has not distributed estate in 3 years. What can I do?

More details to this question:
I have a family member that died in 2017 and willed her estate to family and friends (about 8 people in total). The initial executor of the will was an estate lawyer from Colorado. Soon after her death, he transferred his executor responsibilities to another lawyer in Mississippi. This new lawyer is a public defender and the BROTHER of one of the people named in the will. Instead of dividing the assets as he should, from what I understand, he instead put everything into a trust in his (the lawyer's name). Multiple people in the will have attempted to reach out to him to find out about receiving their inheritance, but all he says is that "you'll hear something soon". It has been 3 years now and nothing (he is no longer answering). what can we do at this point? I am unfamiliar with this area and have no idea where to even start. Any help appreciated.

Write asking for an accounting.  If you do not receive one within 60 days, petition the court to have him replaced.  (The timing differs with states.  Contact a probate lawyer in the county where the probate is pending.)

This is general information. It cannot substitute for a personal consultation with an attorney. It is not intended to be legal advice or imply an attorney-client relationship.
