QUESTION

How can a lost will be replaced or found?

Asked on Sep 13th, 2012 on Wills and Probate - New York
More details to this question:
I have an elderly friend who does not have the will of his long deceased mother (about 30 years) as it was held by the attorney who has long passed away himself and there is no way of contacting anybody who might have his old records. Are the will recorded with the state? He does have his mothers death certificate. Thank you.

It is possible the will may have been kept for 'safekeeping' in the Surrogate Court in the county where she died. If there is a copy of the will, this could be presented to court in a 'lost will' proceeding. Gerry Wendrovsky, Esq.- Upper West Side Lawyer www.upperwestsidelawyer.com
