QUESTION

How can I claim my uncle's house after death

Asked on Jul 09th, 2021 on Wills and Probate - Texas
More details to this question:
My uncle passed in Jan. 2020. He kinda just left his house and now there are squatters. They've changed the name on the electric. I have the deed, but no one really legally got the house when he passed. I want them out. I want the house. Is there a way to get the house put in my name from his from under them and evict them?

In order to change title to the house, a probate proceeding in the county in which your uncle was domiciled at the time of his death is necessary.  If there is no will, then an heirship proceeding will be necessary.  If you fall withing the Texas intestacy scheme of inheritance there is a chance you will inherit some part of the property.  Hire a lawyer.

In order for you to inherit any part of the house or all of that, you will need to start a probate proceeding in the county in which your uncle passed. If you are a legitimate air it is possible depending upon the family tree for you to acquire a title. There is no shortcut way to do this other than in a probate court or a county court of law in the appropriate county.
