QUESTION

How can I contest my deceased mother's will?

Asked on Jul 20th, 2020 on Wills and Probate - North Carolina
More details to this question:
I was left completely out of her will and I am her only child (age 63) with serious health problems. She died January 4, 2019. Her estate was divided up to four people....my son, my daughter, mom's 1st cousin, and mom's ex-stepdaughter. In her will, my MAIDEN last name was misspelled and my daughter's MARRIED last name was misspelled. Mom had changed her will SIX MONTHS before she passed and she was on some serious medication...one of them being HALOPERIDOL. I had contacted a lawyer who wanted $10,000 (or more) and that would've taken 1/3 of my savings. I have been a Type 1 diabetic for 61 years, legally blind, Kidney disease and have had 4 heart attacks. Can you please help me?

I am afraid that you will find that the $10,000 initial retainer quote was on the low side.  Spelling errors and meds are not grounds for overturning a Will:  undue influence and lack of legal capacity are.  Even people who lack legal capacity to the point of needing a guardian may have a lucid moment in which they can make a Will.

This is general information. It cannot substitute for a personal consultation with an attorney. It is not intended to be legal advice or imply an attorney-client relationship.
