QUESTION

How do I find out if my step-father had a will?

Asked on Nov 05th, 2018 on Wills and Probate - New York
More details to this question:
My step-father remarried after my mother died. He just passed away, but a Will has not been filed in surrogate court in NY. How can I discover, if he had a will? He did have a will drawn up when married to my mother years ago. I’m concerned that the 2nd wife may not want the will published and placed in probate. The surviving wife said he never said anything about a will or leaving items to relatives.

Unless filed, you cannot see the will.  However, divorce voids the will made when married to your mother, so that will is not the one.
