How do you probate property, etc. for a brother who had no will

More details to this question:
My brother passed with no will. he has a house and vehicle, etc. His step daughter has taken to living in the house with no authority. She will not leave nor will she let us have the keys, etc. She filled out the death certificate with wrong information.

Contact a probate attorney who practices in the county in which your brother died. When someone dies without a Will, an heirship proceeding determines who inherits. Unadopted stepchildren do not.
