In my uncle's will he left everything to his nieces and nephews (he had no wife or children). Is it true that deceased beneficiaries' children (and in some cases grandchildren of the beneficiaries) receive the portion of the inheritance intended for the niece or nephew? My uncle did not state names in his will, just "nieces and nephews"?
Yes - that's exactly what happens. Lets say there were three nieces and three nephews - each get one sixth of the estate. If one nephew predeceased, his children share his one sixth. the share doesn't lapse - but goes to the next generation. It does may depend on who was a niece of nephew of his by blood - meaning a child of his siblings or by marriage.
