my friend cannot refinance her apartment because the name of her husband needs to be removed from the deed. This one person is deceased. Both names are on the deed. Upon his death, he left a Will, and now the executor (who is his daughter but not my friends relative) is also deceased. The Will is still in effect uless the association is provided proof of the death of the executor. She cannot move forward until this happens. How does she accomplish this, andwhat type of lawyer does she need? Thank you
Hire a probate lawyer who practices in the county in which the husband lived. The court must appoint a successor executor. This person might be named in the Will. If not, the court must appoint someone else. It may be easiest for the widow to apply.
