QUESTION

If my wife pre-deceases her mother?

Asked on Sep 01st, 2014 on Wills and Probate - California
More details to this question:
My wife's mother is 92 and not in good health. Her will leaves 100% to my wife and names her as executor with total discretion in implementing the will. It states also that if my wife cannot carry out the executor's job, then it falls to me. My wife is very ill and may die before her mother. If so, does the inheritance go to me? There is a schizophrenic sister in hospital all her life. She is left nothing.

It really depends on what your mother in law's will or trust says. That is, it should say what happens if her daughter dies before her. If it doesn't specifically say you would get nothing if daughter dies before mom. If daughter dies after mom then it would be different.
