QUESTION

Im frustrated....need help with passed away father's 401k

More details to this question:
My dad passed in 2016 and haven't pursued his 401k tell about 2-3 years ago. I've been struggling trying to Get some progress. I spoke to fidelity and the h.r. department where he worked and nobody at the casino where my dad works seems to know anything about who I talk to. Fidelity investments say they need an employee from my dad's work to call them and inform them of his death before they can do anything. The casino keeps directing me in the wrong direction and giving me multiple emails or numbers which either don't return calls or can't help. So my question is .... Is there a way I can make them help me like a subpoena or something? Is there something that can help me get cooperation? I feel like it's been long enough and I'm tired of going round and around. Someone please help me and guide me... Thank charity

You need to contact the plan administrator.  This person should have been in contact with Fidelity.  If Fidelity cannot provide contact information, send a letter to Plan Administrator, [Name of 401k plan], [Name and Address of Employer] certified mail, return receipt requested.  If there is no response within three weeks, you may need a local attorney's assistance.  A subpoena can only be issued in connection with a court case.

This is general information. It cannot substitute for a personal consultation with an attorney. It is not intended to be legal advice or imply an attorney-client relationship.
