QUESTION

I'm listed as beneficiary, but they refuse to pay.

More details to this question:
My ex husband listed me as his beneficiary, even after we were divorced. He belonged to Local 831 in Southern California. I have been fighting them for over 6 years now and they tell me that because he was inactive (not paying his dues) for a specific amount of time prior to retirement eligibility and we were divorced, I get nothing. However in their own paperwork it states that once fully vested (which he was) an employee will not be considered on a break, which is what they are calling it. Since he was fully vested and I'm the listed beneficiary, then I should receive the pension. When we divorced, I was unaware of my being listed as the beneficiary, but found out a year before he died from a heart attack. We have two children together. I don't know what to do next. Not to mention it was an abusive marriage and divorce and I am owed arrears in child support. David passed away November 8, 2010. This all happened in California and I'm now in Georgia.

It's not clear where you are in the process of contesting the Local 831's denial of your claim, but I would suggest making sure that you use their appeals process and submit your claim (including copies of the paperwork) in writing.   You may have been able to make a claim for child support arrearage from his estate after his death, but my guess is that the time period for any such claim has passed.
