My mother passed away in Aug. Of 2018 there are four of us siblings that are to divide everything equally we that is not happening but my main question is if my name is on the will of my mother's assets meaning her home also well can I be able to stay there at the time I had a insident where I was renting a room a 24 ye old resident was going into my 15 yr. Olds bedroom and getting on top of her needless to say me and her moved out we have no where to go at the moment and my mother's house is just sitting there with no one in it all my other siblings have a key to house but they do not give me one do I have a right to be able to stay there being that I am on the will as part owner of the house with my other 3 siblings do they have the right to tell me I can not stay there
The executor of your mother's Will has a duty to collect her property, pay her debts and distribute the rest according to her Will. It appears that the executor must sell the house and distribute the proceeds to the four children named in the Will. You might ask the executor if you can rent the home in the meantime. The executor does not have to agree to this.
