QUESTION

Is a probate attorney needed if there is no will?

Asked on Aug 02nd, 2021 on Wills and Probate - Texas
More details to this question:
My father recently died with no will and no assets except his family’s home. The property is in his and his late sister’s name. My father had two children, my aunt had three. The five cousins have always known that when he died the proceeds would be split between the two families. Do we have to hire a probate attorney if everyone is in agreement with this arrangement?

Yes you need a lawyer.  A court needs to determine the heirship, i.e. who owns what in BOTH estates.  Depending on the value of the house, there may be several different ways to handle it, especially if everyone is in agreement.
