Is there a time limit on settling an estate?

More details to this question:
In Summary: Both parents passed (2010/2012) and the estate never went through Probate, nor was it opened/settled in any way. A week ago, learned there might be a will that was written when I was around 8 years old (I am now 50 years old) Homestead is paid off. Father has identifiable assets through stocks/liquid assets Not sure if my mother had 401K assets How do I locate the will? Do I have the right as next of kin to settle the estate? (If it's possible, I would like to split half of the value of assets with my only brother)

If a Will cannot be found, it is usually assumed that there is none.  Any heir may then apply to a court to be appointed administrator to settle the estate.  Please contact a probate lawyer who practices in the county in which your parents lived and died.
