Asked on Jul 12th, 2013 on Wills and Probate - New Jersey
More details to this question:
my father just passed a few weeks ago & i'm the only child.I have the original death certificates from the funeral home,we have no idea if he made a will. Were trying to pay off his funeral arrangements by currently getting a administrative bond to release his funds from his banking account. So my question is, is there a way to find out if his had a will?? does it cost to find out? how long does the process take?

Usually there is not a way to determine that.  You can search for the will in the home, or look in the check register to see if there was a payment to a lawyer, or find out if your father used a lawyer to buy his house and call that lawyer to see if he made a will.  If you apply to be the administrator, you will have the same rights as you would if you were the executor under the will.  If you are the only child, then you will inherit the estate
