QUESTION

Is there anyway to avoid Probate?

Asked on May 10th, 2021 on Wills and Probate - North Carolina
More details to this question:
My Mother passed away unexpectedly and did not have a will. She did have some type of life insurance policy, a car (paid off, estimated worth 7,000), and an RV(Paid off, estimated worth 10000). Her Husband has previously passed and me and my sister are the only heirs. We would like to just sell the car and rv and it serves us no purpose and wish to just split the proceeds. My Mother probably owed money to multiple credit card companies however, so we don't know how that will effect us moving forward.

Your mother's estate is liable for her bills.  If you know what they are, in most states you and your sister can file a Small Estate Affidavit and probate the estate without a hearing.
