I am the sole survivor of my family and my mother has no assets but her house which is still under mortgage. I have the affidavit of heirship filed and quitclaim deed. Just needing to know if any debtors call if I should ignore all calls due to her having no will and me not being an executor or if I need to answer and say there was no will addressing estate or estate she left (besides the house) . Banks are at 0 due to a loan and no insurance. I've been told to speak to nobody due to me not being the executor it's not my responsibility and to just wait out the year
A home is only subject to foreclosure for property taxes or mortgage liens. You may ignore the creditors.
Please note that neither an Affidavit of Heirship nor a quitclaim deed pass title. After the Affidavit of Heirship has been of record in the county deed records for five years, a court will rely on it. A title company may in some circumstances rely on it earlier. A quitclaim deed notes that someone quits their claim to an easement, such as a right to use a neighbor's driveway. That is all.
