My mother passed away in December 25, 2019. My sister claims she had power of attorney. She told me that within the past two years mom put all her assets into a trust. Although neither my sister nor mom’s attorney have allowed me access to the documents. Since mom’s passing, I have requested - several times- to be able to see the will, my requests have been ignored. I even asked my sister if I needed to get my own attorney. That request resulted in my sister cutting off all direct communication with her. What should I do?
If your mother put all her assets in a trust, there is no need to probate a Will: the terms of the trust govern. The trust may have been a revocable trust which became irrevocable on your mother's death. It may or may not have named you as a beneficiary. In some states beneficiaries 25 and older are entitled to an annual accounting. A year has not yet passed.
