QUESTION

My predeceased mom was beneficiary to my stepfather's 401K

More details to this question:
The stepchildren and my stepfather's brother and sister are the only heirs listed in the my stepfather's will and everyone is to be treated equally. The stepchildren are not legally adopted by my stepfather, however he has no other biological children. Because my mother was the only beneficiary listed how should the 401K be distributed?

If your mother predeaceased your step father, then the contingetn beneficiaries on the 401(k) will be entitled to the funds.
