QUESTION

My younger brother died without a will. He has no real-estate.

More details to this question:
I understand I can I can fill out an Affidavit for collection of personal property and have it notarized after the 40th date of his passing. What do I do with the affidavit from there? Do I need to go to some type of court or does the notarized affidavit act as my legal documentation? In advance, thank you.

If you are the one entitled to the assets you would take the small estate affidavit to the financial institution that has the asset. Bank, stock broker, etc....  They should release the funds to you. This procedure is if the total assets are less than $150,000. Good luck.
