I am the only child and surviving heir to my father's estate. There is no will or trust and now 6 years after his death we must file probate to claim insurance proceeds with no beneficiary named. He lived with me and my wife for 4 years in Mariposa, ca. Then he went to a temporary situation in me memory care in another county for 2 years. We continued to file his taxes with Mariposa county as his home as we planned to hospice him there. His drivers license and registration are also in Mariposa county. Can we file probate in Mariposa county even though he died in Monterey county
File in the county where he died unless he was there temporarily and had real estate in another county. You cannot represent his estate. You must hire a probate attorney who practices in that county.
