My parents died there are 4 adult children 1 doesn't care about the estate, 2 are greedy and want everything to themselves, and I was forced to move from my home unless I bought the 2 out of the property because it was one of the 3 lots left to us. The other 2 lots have my parents home on it next door. My brother moved into the house won't allow me on property and refuses to give me my share! What can I do?
The Will or, if there is no Will, the question of heirship, must be admitted to probate by a court. Once the court has appointed an executor or, if there is no Will, an administrator, it is that person's duty to gather the assets, pay the debts and distribute the rest to the beneficiaries under the Will or to the heirs. If this is not done within a certain period, that person can be replaced. In this instance, you may sue for partition, forcing a sale and getting your share of the net proceeds.
