My sister passed away & was not married but co habitated for years but the state she lived in doesn't recognize common law marriages. Her significant Other has hired a probate lawyer but not certain if sister had a will or if she did if if it was filed under duress or if sound mind. Only living blood relative is me. I am beng asked to give information without all the details or copy of will if there was one. Who is eligible for survivor benefits and debts and should I contest the probate and/or will and how do I best handle this matter. I do not and have not been provided a copy of the will if there is one. Need to understand rights & how to handle
As next of kin, if there is a will, you need to be served with a citation for probate. You are also entitled to a copy of the will. Who is asking for information? Death benefits usually have a pay on death provision, and the boyfriend might be that person. One way to handle it is to file an administration as next of kin, and see what shakes out.
