More details to this question:
My parent passed leaving home with no will. Will be CA probate. One sibling may want to purchase. The other siblings want to sell. Sibling who stated interested in buying is being hostile with the other siblings so at this point the majority want to sell. Will the Court decide to allow the one sibling to purchase the home, or does the majority decision rule? Does the Court decide?

Step one, settle the estate. Step two, those siblings who want to sell, sell. Combined step one and step two, settle the estate with a Family Settlement Agreement. Alternative Approach Step one, settle the estate. Step two, those siblings who want to sell, sell. Step three, one or another co-owner sues for partition, forcing the sale.
