Rights to property

More details to this question:
My son , his father and I reside in TN. Father passed suddenly. Property in KY that he owns paid in full, his mother currently occupy. Would this property not legally be assigned to son? No living will, we were not married, but together 20 years. His dad always wanted that property to go to son and doesn't want other family to try obtain possession or sale.

It appears that any wife is dead.  If so, the children would inherit.  These include your son.  He must apply for a determination of heirship.  Depending on his age, you may be able to apply on his behalf.  Contact a probate attorney who practices in the county in which the father died.
