QUESTION

SC Probate Court

Asked on Apr 10th, 2019 on Wills and Probate - Maryland
More details to this question:
The estate has creditors and the only assets to pay them are 2 homes. 1 in SC and 1 in MD. MD has a mortgage and is one of the creditors as well as I. Creditors are working with me and i am willing to let the funeral expenses go and the siblings just want it over with. I would like to sell the SC house which is in disrepair. I do have a realtor willing to handle it. But if it does not fetch enough to pay the creditors, will I have to sell the one we still live in? The court is saying to avoid a hearing, I need to get a Consent and Waiver form sign by each creditor and sibling which is not a problem. I have been reaching out to attorneys for over a year and cannot afford the prices. Thanks for your assistance.

You may qualify for free representation through Volunteer Legal Services or, if not, for the Modest Means program through Lawyer Referral Services.  The SC court may have a pro se (for self) program in which court personnel or attorneys will assist someone representing themselves. The likelihood of getting adequate advice on a nationwide listserv from attorneys who have not seen the documents and do not know the full situation is slim.

This is general information. It cannot substitute for a personal consultation with an attorney. It is not intended to be legal advice or imply an attorney-client relationship.
