QUESTION
Sue the bank for violating my rights
Asked on Jul 04th, 2019 on Wills and Probate - New York
More details to this question:
My mother's account was frozen I was the poa on the account. She had drawn up a irrevocable trust with one beneficiary her granddaughter, but because the bank didn't release the hold on the account I couldn't fund the trust. Now my mother's wishes in her trust will not be upheld due to the banks negligence. I have 5 other siblings which we are not mentioned in the trust. The court will now divide the money 5 ways. Her granddaughter will not receive anything although she would have been the sole beneficiary of her estate.

Sounds like you just screwed up the planning. A POA ends at death. The trust was not the beneficiary on the account, based on your post. But, it could have been. Because the account became part of the estate instead of the trust, the trust could not be funded. I see nothing the bank did wrong.
