QUESTION

the executor will not provide me with proper documentation of a trust account.

More details to this question:
mother died 1-1/2 yrs. ago. brother is named executor, told me he put in 25,000.00 to start trust, all expenses were deducted from that, funeral,re-pass, house painting, etc. house sold --money was put in account-proceeds were equally divided. said he wants 15 per cent for his fee-when i asked for copies of bank statements, etc he told me he would not take a fee and equally divide the remaining balance,$27,500.00 and I must sign a paper saying I will not bring this up again. Is it worth it for me to fight this-or should I just take the money?

The executor's fee is not 15%.  The executor's fee is much smaller, only 5%.  Its up to you - figure out how much additional your bother took and ask for a credit for that amount of what you are to receive.
