QUESTION

Waiver of Bond required to proceed in a private case?

Asked on Mar 12th, 2021 on Wills and Probate - Massachusetts
More details to this question:
My uncle is serving an executor to an estate for which I am an heir. He has asked that I sign a Waiver of Bond, claiming the request is from the judge and they will not move forward with the process unless it is signed. This seems wrong to me. Is this a lie? How can I go about contacting the judge or verifying this? He is in South Carolina and I am in Massachusetts.

While you cannot contact the judge, you can determine whether you want the estate administration supervised by the court (which is more expensive) or not.  If you do, do not sign.  It is not a request from the judge.

This is general information. It cannot substitute for a personal consultation with an attorney. It is not intended to be legal advice or imply an attorney-client relationship.
