What happens to property before probate?

More details to this question:
My brother is living in my moms home. He has people living in there as well. No one is paying the mortgage. How do I get him out so the home can be sold?

Until the probate estate is established and the personal representative appointed, there is nothing. You need to file the probate estate and get appointed as the personal representative before the house can be sold, and before you can actually do anything.
