What happens when there is no will?

More details to this question:
My sister passed with no will; she owns a house with a loan lien and a car free and clear. Do I need to go through probate to make a claim to the assets so the house can be sold to pay the loan? Or does it automatically go to the nearest living relative?

Unless the deeds to the house and car specifically pass title to other members of the family, then you will need to go to probate.
