This matter is over inheritance to myself and another sister. She is petitioner and administrator over my eldest sisters estate . She gets $60,000, and me $30,000. 2 years in probate. Now won’t sign check over to me. Lawyers in Calif., we are both in Texas. Lawyers work for her they said, not me, but sympathetic. She won’t sign a check over time. Withholding the money. So, do I now need to hire a lawyer for relief? I am retired, disabled, SSDI, single, live alone for years. No contact with this sister, harassed by her daughter to give her money tho. In most, maybe all, states, if you have not received a distribution in a certain period of time (say, two years after the executor is appointed, as in Texas), you can ask the court to replace the executor (maybe with you). You do need a probate lawyer who practices in the county in which the probate proceeding is pending. You may be eligible for free representation through Volunteer Legal Services there or, if not, qualify or the Modest Means programs of the local Lawyer Referral Services.
