When is probate needed?

More details to this question:
We are trying to sell my late mother in laws home. My husband and his brother are her Only heirs. Do we need to file probate? She has no debt and most of her estate is settled.

Unless the deed to the property was in jtwros then yes you will need to file a probate action to clear title to the property to the correct heirs.  that will depend on whether or not their is a will.
