QUESTION

Are all workers compensation monetary resolutions based on what the standard impairment rating is?

Asked on Apr 03rd, 2017 on Workers Compensation - Tennessee
More details to this question:
My husband broke his foot(lisfranc fracture) and it was a workers comp issue, surgery and out of work pay taken care of. Second surgery to remove foot hardware. Still in constant pain, his job as an electrician requires him to be on a ladder which is the worst movement for a foot. Workers compensation only gives a certain impairment rating to the type injury he has. How do we finds out if there is additional compensation available due to his injury and if hiring a lawyer is the only way to determine this? Looking to resolve the workers compensation issue and get relief from the constant pain which effects the way he walks and his daily happiness. Surgeon who performed the surgery claims there is nothing more that can be done to relieve the constant pain.

As a general rule, the amount of compensation is based upon the impairment ratings. However, there is a way to get more but you would need an attorney. As to the pain he is in, there is nothing that the law can do about that.
