Carpel tunnel

More details to this question:
I had carpel tunnel surgery in November 2015 in Virginia. I am still not back to work. STD insurance is refusing to pay anything past January 31 even though doctor has not released me. I have a court hearing in April for workers comp. I am being told this is a waste of time by the insurance company because Virginia does not recognize repetitive motion injuries. My question - should I cancel the court hearing? If I am going to get denied I would rather not spend the money on gas.
