QUESTION

Do I have a chance at getting workers compensation?

Asked on Oct 04th, 2013 on Workers Compensation - Pennsylvania
More details to this question:
I work at a retail store and I was unpacking scarves when I had a horrible allergic reaction and broke out in hives all over my body. I went through so many doctors visits to figure out what it was because the hives on my legs turned purple. I found out that it was hypersensitivity caused by hives from an allergic reaction. I was denied workers compensation and I just want to know if it is worth pursuing a lawyer and fighting it. They said that I was denied because i did not suffer a work related injury, but there is also a box beside the spot that says that the injury was not within the scope of employment. But, the hives appeared at work and I still work there so I'm not sure why.

Based upon your description, it is likely at least worth calling a lawyer to discuss the possible case.  The scope of employment issue is not cut and dry many times and an experienced lawyer can look into it.   Scott Cooper scooper@schmidtkramer.com 717-888-8888
