In a Work Comp settlement is a set aside required by law?

More details to this question:
66 year old medicare beneficiary who sustained OTJ knee injury - all medical bills to date covered by Work Comp insurance but employee cannot perform job any longer

If you are on Medicare, a workers compensation settlement that surrenders medical care as part of the settlement will need Medicare approval. Oftentimes, that approval is obtained by submitting an MSA or Medicare Set Aside proposal to Medicare to pay the future medical bills necessitated by the accident.
