Went to mediation settlement my attorney said several times I can get you $10,000. When with my attorney and mediator my attorney brought up the $10,000 again and the Mediator looked puzzeled and as far as I no the other party didn't know of the $10,000,After that it was never offered again from our attorney cause the other party never offered it.Was my lawyer misleading me.My attorney told me I have no choice but to close the case because he will no longer represent me but he offered me part of his attorneys fee that the other party pays him.What should I make of this?
From what you have written, apparently your lawyer felt that your case had more value than did the mediator and the other attorney. That sometimes happens.
You have the option to discharge your attorney and perhaps to dismiss your case, with the right to refile within a year, so that you can seek new counsel.
However, if your attorney had put a top value of $10,000 on your case and the other side was offering less, then your case might not be that attractive for a new attorney to take and then have to start from the beginning.
Your best option is to meet with your attorney and find out exactly what you would net from whatever amount was offered and then decide if making a change is really cost effective.
