I am a mechanic. I was injured at my job about a year ago. I have herniated disks in my back. To make a long story short, workers comp wouldn''t pay any longer and it became a settlement case. I since started a new job and had no problems for a year. While at work (new job) my back completley gave out and I have been out of work for a week. Do I need to apply for workers comp? Can I qualify for this since the injury was from a previous job, but flared up at new job? I''m not sure what to do. My boss is not too happy with me missing work, and I just know this isn''t going to end well either way I go.
You likely have a new workers' compensation claim against your new employer. If your doctor from the first claim released you and you have been working without many problems then you should get medical treatment from the new Employer's workers' comp Carrier. I would be happy to speak to you in more detail. Please call me for a FREE consultation at (877)817-4127.
