What recourse do I have?

More details to this question:
I work with steel. I hurt my lower back at work about 3 years ago rolling a railroad tie. One bulging disc and one ruptured. Following 1.5 years of conservative treatment it was determined I needed surgery. During the 1.5 years I continued to work on light duty with a 25 pound weight restriction. I lost a great deal of muscle mass during that time. I was referred to a surgeon and I had a laminectomy with 6 weeks recovery time. I was then released to full duty. I was re-injured that first day back at work. Fast forward to recovery following the 2nd surgery to fix the same disc, and I am in the same exact situation. I am a shell of what I once was and am in no physical condition to return to work, but I've been declared at MMI and released to full duty. What recourse do I have? Work hasn't received the official report from the doc, so I haven't returned yet, but I fear re-injury is inevitable.

You have the right to a medical evaluation with a doctor of your choosing that the employer/insurance company has to pay for.  This right is triggered once they get thier rating from their doctor.  That doctor can also comment on restrictions that he/she recommends for your condition.  Then, you will have the information you need to evaluate your case.     I do recommend you consult with an attorney about the value of your case and your options regarding settlement.    Donna Miller 515-245-4300 http://www.grefesidney.com/our-team/donna-miller/
