QUESTION

What to do about formally denied decision on workers comp

Asked on Jul 18th, 2014 on Workers Compensation - Virginia
More details to this question:
I filed for a recurrence on my hands on March 28, 2014 and was formally denied on July 7, 2014. The doctor put me off work permanentally in March so I applied that day also applying for my social security disability. The only time I was able to talk to my caseworker was to be told that I couldn't retire on comp. I was approved in 1994 for carpal tunnel and rotator cuff. Had to have 2 surgeries on each hand and surgery on my shoulder and was put on permanent limited duty in 1996 up to the currant date. They changed my job duties to typing and writing up to 3 hours daily and after working in pain for 18 years I just couldn't do it anymore. I tried to talk to my caseworker but could never get her on the phone and the messages I left were never returned. I know I will have to file an appeal The dr reports I have state that there is not much to be done. The pt report says he thinks he could help with pt and heat and cold. It also shows my weakness in my handsI tried to talk to my caseworker but could never get her on the phone and the messages I left were never returned. I work for uspo

If your injury occurred 18 years ago, it may be too late to claim any WC compensation for this injury. If you did obtain a WC award back then you may still be able to pursue medical benefits under that award. You can call the Virginia Workers Compensation Commission 1-877-664-2566 to check on the status of your case. You can qualify for Social Security if your doctors say this problem makes you "unable" to do "any" work. I base this opinion on 35 years of practice as a WC lawyer.
