QUESTION

Working when I was hurt

Asked on Jun 17th, 2014 on Workers Compensation - Virginia
More details to this question:
I hurt my knee over the weekend playing golf. I went to work Monday and it started hurting again. So i called my boss and told her my knee was hurting and i began to limp and my foot was going numb. She then said she will me meet to get on the delivery truck with me and I had to work on it all day. Now she wants me to sign a note saying I hurt it over the weekend because I'm going to the doctor today to get it look at. Plus i had a old workers comp injury on the same knee twice. Should i sign the note?

I have practiced Virginia Workers Compensation law for 35 years. You indicate you have injured this knee twice at work and now once playing golf. You need to discuss with your doctor whether this is a continuation of your earlier work injury or a new off the job golf injury. If it is totally due to the golf injury then you have no claim for workers compensation and you need to have it taken care of under your health insurance. If it is a continuation of your earlier workers compensation claim then you need to speak to a workers compensation lawyer. There may be time limits that affect your claim.
