My doctor has taken me from temporarily totally disabled to light-duty I have to do job searches weekly my lawyer has informed me that since I am now on light duty a percentage of my weekly compensation is taken by the law firm is that correct? If so why being that I have not settled the case and I am not back to work yet? What is the difference and receiving full disabled benefits about slight Duty benefits? Is it not required that my job offer me a position in a different department that accommodates my restrictions if other positions are available within the company? What can I do if I'm displeased with the services being given to me?
Your lawyer is entitled to receive 20% as a legal fee on your temporaty partial disability benefits. You will be required to perform job searches while you are on light duty. If you are displeased, you can find another lawyer, but you former lawyer is still entitled to received a portion of the legal fee, ie. you new lawyer will have to share the legal fee with the old lawyer. If there is not a lot of money involved, this may make it difficult to find a new lawyer.
