QUESTION

I found a business with my business name

Asked on Jun 28th, 2021 on Internet Law - Texas
More details to this question:
I have spent that last few weeks starting a small 3d printing business and my chosen name did not appear in any data base searches i did. So i set up tons of accounts and got everything finished but the assumed name filing for sole proprietorship, which I have filled out. The business in question has no website or anything i can find except for a facebook page for his personal trainer business with is in the name. Business name personal trainer and nutrition, where mine i business name or business name 3d printing services, whichever would be allowed. The only other things i can find with my name is a tiktok username and a username on an art website. Am i clear to file my assumed name application? Should I contact the facebook pages owner?

A business name and a trademark are not the same thing.  However, your description says you can find him on the Internet using the name to promote his business.  That use gives him priority in Trademark law. There will be other questions you find as you seek to open an e-commerce web site or App.  In my experience, working with a lawyer as you begin will save you a lot of money in the future.   I have written a legal guide with issues you will need to discuss with an  Internet attorney.  I have placed a link here for your convenience: http://www.avvo.com/legal-guides/ugc/legal-steps-to-opening-a-new-e-commerce-website-app-or-blog
